General Terms of Sale
These terms apply to all sales B2C concluded by BUTTON SPIRIT through the site buttonspirit.com.
These conditions are only valid for individuals and do not apply to any professional.
Article 1 – Price
1.1 – The prices of our products are listed in Euros, and include all taxes included and exclude all processing and shipping fees. The shipping charges mentioned cover not only the cost of mailing but also the costs of preparation and processing of the order. Therefore, shipping costs stated on the package differ from the shipping costs charged upon ordering.
1.2 – For all products shipped outside the of European Union and in DOM-TOM, customs fees or other local taxes or import duties or state taxes may apply. These amounts are charged to the customer and are the client’s responsibility when declaring payment to the competent authorities.
1.3 – BUTTON SPIRIT reserves the right to change its prices at any time but the products will be charged on the basis of the rates in force at the time of order validation.
1.4 – The products remain the property of BUTTON SPIRIT until full payment of the order.
Article 2 – Validation
You declare that you have read and accepted the General terms of sale before placing your order. The validation of your order constitutes your acceptance of these General Conditions of Sale.
Article 3 – Delivery
3.1 – General
The products are delivered to the delivery address provided during the order process. Items are shipped within 48 working hours following the order, subject to availability. Delivery times are generally 2-3 business days from the shipping date in metropolitan France, except in cases of force majeure (strikes, acts terrorists, wars, weather, and natural disasters…). You can find all details about delivery times and shipping costs here.
3.2 – Conditions
You must notify the carrier and BUTTON SPIRIT of all issues with the delivered product (for example: damaged parcel, already open…). In cases set out in section 9 below, you can benefit from the Exchange or Refund Conditions provided in this article.
3.3 – Responsibilities
Deliveries are made to the delivery address indicated in the order form, only within the agreed geographical area. Risks become the responsibility of the purchaser as soon as the products have left the premises of the BUTTON SPIRIT partner.
BUTTON SPIRIT may not be held liable for any loss or theft of your package in transit. No compensation other than that provided for in the General Conditions of our partner can be demanded…
For La Poste deliveries, the availability status will prevail. If the status shows that the parcel is lost in the mail or damaged, BUTTON SPIRIT will then pay for shipping your new package.
Article 4 – Payment
At any time, the collected amounts can be considered as payments or instalments.
The payment for your purchases can be made:
– by credit card: Visa, MasterCard, American Express, other blue cards (e-credit card). The card is debited upon validation of the order on the site.
Article 5 – Security
Our site is protected by a security system.
We have adopted the SSL encryption process, but we have also strengthened the overall scrambling and encryption procedures to protect any sensitive data related to methods of payment.
Article 6 – Satisfaction or refunded within 14 days – right of withdrawal
6.1 – In accordance with the legal provisions in force, you have a period of 14 days from the receipt of your products to exercise your right of withdrawal with BUTTON SPIRIT without any reason or penalty.
In case of exercise of right of withdrawal within the above-mentioned period, only the price of the purchased product and shipping costs will be reimbursed. The return costs are your responsibility.
The returns are to be carried out in their State of origin, and shall be complete (including packaging) and accompanied by a copy of the purchase invoice. Attention: we do not accept returns by registered mail.
You will receive a notification upon receipt of the returned package, and the refund will be made within a period of 30 days.
This right of withdrawal is not applicable to custom products, in accordance with article L121-20-2 of the Consumer Code.
6.2 – Return address: the products are to be returned to BUTTON SPIRIT, 80 rue de la croix Nivert – 75015 Paris.
Article 7 – Product Compliance
We promise to pay back you or to exchange defective, worn or damaged products, or products that do not match your order.
In this case, we kindly ask you to notify us via email at firstname.lastname@example.org and to send us a picture of the article in question.
We then ask you to return the products to us and BUTTON SPIRIT will, at your option, exchange or refund of the product.
The return fees will be reimbursed up to Colissimo rate in force upon presentation of the receipts.
In any case, you are entitled to legal guarantees of conformity and hidden defects, according to the legal provisions in force. The provisions of this article do not entitle you to the right of withdrawal provided in article 6.
Article 8 – Refund
Product reimbursements in the cases listed in articles 7 and 8 will be made promptly, and at the latest within 30 days of the date on which the right was exercised.
The refund will be made on a proposal from BUTTON SPIRIT by a credit on the customer’s bank account or by a cheque addressed to the customer who placed the order and to the billing address.
Article 9 – Intellectual Property
All text, comments, works, illustrations and images reproduced or represented on the BUTTON SPIRIT site are controlled by copyright and intellectual property for the entire world.
As such and in accordance with the provisions of the Intellectual Property Code, only private use under even more restrictive provisions of the Intellectual Property Code is authorized.
Any whole or partial reproduction or representation of the BUTTON SPIRIT site or of all or part of the BUTTON SPIRIT site elements is strictly prohibited.
Article 10 – Liability
The products offered comply with the French legislation in force. BUTTON SPIRIT shall not be held liable in the event of a failure to comply with the legislation of the country to which the product is delivered.
The photos are provided as an illustration and are the property of Button Spirit.
Article 11 – Applicable Law
This contract is subject to French legislation in force. In case of a dispute, the French courts will be exclusively competent.
Article 12 – Personal Data
Information and data about you is needed to process your order and facilitate our trade relations.
They can be sent to companies that contribute to these relations, such as those responsible for the execution of orders for their management, execution, processing and payment and services.
Such information and data are also kept for security purposes, in order to meet legal and regulatory obligations and to improve and customize the services we offer and the information we send you.
In accordance with the Data Protection Act of January 6th, 1978, you have the right to access, rectify and oppose your personal data. Simply write to us online or by mail at BUTTON SPIRIT, 80 rue de la croix Nivert, 75015 Paris and indicate your name, email address.
In accordance with the regulations, your application must be signed and accompanied by a photocopy of an identification card bearing your signature, and must specify the address to which we must send the response. A response will be sent within 2 months of receipt of the request.
Depending on the choices you made while creating or viewing your account, you will likely receive offers from our company, as indicated during the account creation process. If you no longer want it, you can make the request at any time.
